Where content published by Varadigara is truthful and can be substantiated by evidence in Varadigara’s possession at the time of publication or thereafter, Varadigara will assert the defence of truth (justification) in any defamation proceedings. The burden of establishing malice or reckless disregard for truth lies with the complainant.

8.3 Fair Comment Defence
Opinion, commentary, and editorial content published by Varadigara represents fair comment on matters of public interest and is protected as such under the exceptions to defamation provided under the Bharatiya Nyaya Sanhita 2023 and its predecessor legislation. The expression of opinion, however strongly worded, does not constitute defamation provided it is identifiable as opinion and is based on facts that are stated, referenced, or generally known.

8.4 Public Interest Defence
Where Varadigara publishes information that may be characterised as sensitive or damaging to a person or institution, such publication is made on the basis that:
cc. The subject matter is of genuine public interest;
dd. The information was obtained and verified through legitimate journalistic means;
ee. The affected party was given a reasonable opportunity to respond where practicable;
ff. The public benefit of publication outweighs any private harm caused.

The responsible publication defence, recognised in Indian jurisprudence and international press freedom standards, applies to all such content.

8.5 Right of Reply
Varadigara endeavours to contact subjects of adverse reporting before publication to offer an opportunity to respond. Where a subject chooses not to respond, declines to comment, or cannot be reached within a reasonable timeframe, Varadigara may proceed with publication and will note the absence of a response in the published article. This process demonstrates good faith editorial practice and shall be considered by any adjudicating authority in assessing Varadigara’s editorial conduct.

8.6 Reporting on Public Institutions and Government
Varadigara’s reporting on government bodies, public institutions, elected representatives, and public officials is conducted in the exercise of the fundamental right to freedom of press under Article 19(1)(a) of the Constitution of India, read with the public’s right to information on matters of governance. Such reporting constitutes a protected journalistic activity. Any attempt to use defamation law, contempt proceedings, or regulatory mechanisms to suppress legitimate public interest journalism will be resisted by Varadigara through all available legal means, and Varadigara reserves the right to report publicly on any such attempt.

8.7 Subsequent Discovery of Inaccuracy
Where a report published by Varadigara in good faith is subsequently found to contain inaccuracies due to:
gg. False or misleading information provided by a source;
hh. Documents that were later found to be fabricated or altered by a third party;
ii. Events or facts that were not known or reasonably knowable at the time of publication;
jj. Statements made by public figures that were later retracted or contradicted by subsequent events;

— Varadigara shall not be held liable for such inaccuracies provided that upon becoming aware of the error, Varadigara publishes a correction, clarification, or update in a timely manner. Good faith publication followed by timely correction constitutes responsible journalistic conduct and shall not be treated as evidence of malice or reckless disregard for truth.

9. GOVERNING LAW AND DISPUTE RESOLUTION
9.1 Governing Law
These Terms are governed by and construed in accordance with the laws of India, including but not limited to the Information Technology Act 2000, the Bharatiya Nyaya Sanhita 2023, the Copyright Act 1957, and applicable press and media regulations.

9.2 Jurisdiction
Any dispute arising out of or relating to these Terms or the use of this website shall be subject to the exclusive jurisdiction of the courts of Mangaluru, Karnataka, India.

9.3 Dispute Resolution
Before initiating any legal proceedings against Varadigara, the aggrieved party agrees to first notify Varadigara in writing of the nature of the dispute and provide Varadigara with thirty (30) days to respond and attempt resolution. This requirement does not apply in cases where immediate legal relief is sought.
